1.   Purpose and Origin of the Report Te Pūtake Pūrongo

1.1       The purpose of this report is for the Waipuna Halswell-Hornby-Riccarton Community Board to consider confirming the appointment to the extraordinary vacancy on the Board arising from the resignation of Community Board member Gamal Fouda.

1.2       This report is staff generated to enable the Board to consider confirming the appointment previously resolved at its meeting on 10 April 2025.

1.3       Confirmation of the appointment is required following the public notification process in accordance with the Local Electoral Act 2001.

2.   Officer Recommendations Ngā Tūtohu

That the Waipuna Halswell-Hornby-Riccarton Community Board:

1.          Receives the information in the Confirmation of Appointment to Extraordinary Vacancy on the Waipuna Halswell-Hornby-Riccarton Community Board.

2.          Notes that the decision in this report is assessed as low significance based on the Christchurch City Council’s Significance and Engagement Policy.

3.          Resolves to confirm the appointment made at its meeting on 10 April 2025 of Luke Chandler, being a person qualified to be an elected member and being a person who lives in the Riccarton Ward, is active in the community, is experienced in representing their community’s concerns to the Board and the Council, supports the Board’s three priorities of the Riccarton ward, can commit to attending all regular meetings, information sessions and community board events and was the highest polling unsuccessful candidate for the Riccarton Ward at the 2022 local body elections to fill the vacancy on the Board created by the resignation of Gamal Fouda.  

3.   Background/Context Te Horopaki

3.1       The Board received notice, given under section 117(2) of the Local Electoral Act 2001, from the Chief Executive on 31 March 2025, that Community Board member Gamal Fouda had resigned from the Waipuna Halswell-Hornby-Riccarton Community Board effective immediately.

3.2       This created an extraordinary vacancy on the Community Board. Where a vacancy occurs within 12 months of the next triennial local government election, a by-election is not required, and the Board had the option to either leave the vacancy unfilled or appoint a person to fill the vacancy for the remainder of the triennial term.

3.3       At its meeting on 10 April 2025 the Board resolved:

 1. Pursuant to Section 117(3)(a) of the Local Electoral Act 2001 resolves to fill the vacancy on the Board created by the resignation of Gamal Fouda by the appointment of  Luke Chandler, being  a person qualified to be an elected member and being a person who lives in the Riccarton Ward, is active in the community is experienced in representing their community’s concerns to the Board and the Council, supports the Board’s three priorities of the Riccarton ward, can commit to attending all regular meetings, information sessions and community board events and was the highest polling unsuccessful candidate for the Riccarton Ward at the 2022 local body elections.    

2. Resolves to give immediate public notice of its decision.

3.4       Section 118 (1) of the Local Electoral Act 2001 requires that if, under section 117(3)(a) community board resolves that a vacancy will be filled by the appointment of a person it must immediately, give public notice of—

(a) the resolution; and

(b) the process or criteria by which the person named in the resolution was selected.

3.5       Pursuant to Section 118(1) a public notice advising of the Board’s resolution to appoint Luke Chandler and outlining the criteria for the appointment was published on the Christchurch City Council’s website on Friday, 11 April 2025.

3.6       Luke Chandler has confirmed that he is willing to accept the appointment to the Waipuna Halswell-Hornby-Riccarton Community Board.

3.7       Section 118(2) of the Local Electoral Act 2001 provides that community board must, at a meeting held not later than the expiry of the prescribed period, by resolution confirm the appointment described in the resolution under subsection (1); and the person appointed is for all purposes to be treated as having been elected to fill the vacancy on the date on which that resolution is made.

(4) If for any reason the person specified in the resolution is unavailable or otherwise unable to be confirmed in the appointment, a further vacancy occurs in that office.
