Purpose and Origin

·    This briefing will provide an update on the Central City Noise Plan Change, including the proposed timeline, the Schedule 1 process under the Resource Management Act 1991 which Council is required to follow, the proposed scope and principles of the plan change, and a high-level summary of the initial expert advice.

·    The Urban Regeneration team will update councillors on the range of non-regulatory actions undertaken over the previous year, including:

Completing the ‘Sounds in the City’ webpages; and

Support for identity-building (Neat Places articles, social media).

·    Council resolved in April 2023 to commence a plan change process to the District Plan, including an evaluation of options for managing effects of noise in the Central City.

Timing

This information session is expected to last for 45 minutes.

Outcome Sought

That Council is informed of the statutory process and proposed timeline for the Central City Noise Plan Change, including key dates for engagement and notification of the plan change.

That councillors have had the opportunity to ask questions on the plan change and seek clarification on timeline and process.

ELT Consideration

ELT have been informed of earlier advice to elected members on the proposed plan change.

Next Steps

The next steps will be informed by the feedback from elected members at this briefing. Staff will take on board feedback in finalising the process and next steps. We’ll continue work on the Section 32 Report to consider options for amending the District Plan and assess their respective costs and benefits.

Our next update to Council will be an Information Session in May on the options for proposed changes to the provisions prior to public engagement commencing in June.

Thereafter, approval will be sought from Council in September for notification thereafter.

Key points / Background

·    Council is preparing a plan change to amend the noise rules in the Christchurch District Plan that apply in the Central City, particularly as they relate to live music and entertainment activities, and the mixed-use environments within the four avenues.

·    Alongside the regulatory work programme, the Urban Regeneration team have been undertaking work to support both residents and live music venues based in the Central City and raise awareness of the noise levels anticipated in the Central City environment.

·    Council is required to follow the Schedule 1 process set out in the Resource Management Act 1991 when preparing a plan change.

·    Issues identified to date include potential reverse sensitivity effects of residents complaining of live music / noise from entertainment activities that could reduce  the ability for entertainment activities to continue operating, e.g. noise control notices for an extended periods; that noise limits are too restrictive for entertainment activities in some locations, and that the noise insulation requirements for sensitive activities are insufficient in some locations, having regard to the levels of noise.  

·    The plan change is reviewing noise limits, insulation requirements for residential activities, and the precincts for louder noise from entertainment and hospitality activities introduced into the District Plan through an addendum to the Christchurch Central Recovery Plan.

·    The review of the central city noise rules was delayed due to priority being given to Plan Change 14 Housing and Business Choices (PC14).

Surface Flooding Reduction Programme Prioritisation - Workshop 1

Free and Frank Discussion

The workshop is required to inform the early stages of the programme definition.  As the programme is a Council led initiative Staff require a fulsome discussion with Councillors on expected outcomes and drivers. 

The workshop does not directly relate to an immediate decision to be made by Council.

Staff need to have a free and frank engagement with Council to allow for appproriate and effective programme criteria to be arrived at.

Subsequent steps in the process will be in the public domain so the results of this workshop will become public in due course.  Review of this can be undertaken upon Council resolution to accept the programme project identification.
