THREE WATERS INFRASTRUCTURE AND ENVIRONMENT committee of the Whole - Terms of Reference Ngā Ārahina Mahinga

Delegations

The Council delegates to the Three Waters Infrastructure and Environment Committee authority to monitor and make decisions on:

·                Water supply, conservation and quality (for the avoidance of doubt the Council retains its authority on matters relating to the Governments Water Reform).

·                Receive regular updates from the Water Management Zone Committees.

·                Stormwater drainage including the Land Drainage Recovery Programme.

·                Natural environment, including the waterways, aquifers, ecology and conservation of resources.

·                Natural hazards protection, including flood protection and river control.

·                Solid waste collection, processing and disposal including landfills.

·                Sewage collection, treatment and disposal.

·                Applications to the Biodiversity Fund.

Bylaws

The Council delegates to the Committee authority to:

·                Oversee the development of new bylaws within the Committee’s terms of reference, up to and including adopting draft bylaws for consultation.

·                Oversee the review of the following bylaws, up to and including adopting draft bylaws for consultation.

o      Trade Waste Bylaw 2015

o      Waste Management Bylaw 2009

o      Water Supply, Wastewater and Stormwater Bylaw 2014

Submissions

·         The Council delegates to the Committee authority:

·         To consider and approve draft submissions on behalf of the Council on topics within its terms of reference. Where the timing of a consultation does not allow for consideration of a draft submission by the Council or relevant Committee, that the draft submission can be considered and approved on behalf of the Council.

Limitations

·                This Committee does not have the authority to set project budgets, identify preferred suppliers or award contracts. These powers remain with the Finance and Performance Committee.

·                The general delegations to this Committee exclude any specific decision-making powers that are delegated to a Community Board, another Committee of Council or Joint Committee. Delegations to staff are set out in the delegations register.

·                The Council retains the authority to adopt policies, strategies and bylaws.

·                The Council retains its authority on matters relating to the Governments Water Reform.

·                The following matters are prohibited from being subdelegated in accordance with LGA 2002 Schedule 7 Clause 32(1) :

·                the power to make a rate; or

·                the power to make a bylaw; or

·                the power to borrow money, or purchase or dispose of assets, other than in accordance with the long-term plan; or

·                the power to adopt a long-term plan, annual plan, or annual report; or

·                the power to appoint a chief executive; or

·                the power to adopt policies required to be adopted and consulted on under this Act in association with the long-term plan or developed for the purpose of the local governance statement; or

·                the power to adopt a remuneration and employment policy.

Chairperson may refer urgent matters to the Council

As may be necessary from time to time, the Committee Chairperson is authorised to refer urgent matters to the Council for decision, where this Committee would ordinarily have considered the matter. In order to exercise this authority:

·                The Committee Advisor must inform the Chairperson in writing the reasons why the referral is necessary.

·                The Chairperson must then respond to the Committee Advisor in writing with their decision.

·                If the Chairperson agrees to refer the report to the Council, the Council may then assume decision-making authority for that specific report.

12. Tri-annual Zone Committee Update Report - November 2021

 

Committee Comment

1.         The Committee requested that the Council write to Environment Canterbury encouraging them to continually update the data and the Groundwater Modelling.

2.         The Committee noted that Kevin Brown was stepping down from his role as Chair of the Christchurch West Melton Management Zone Committee and wanted to acknowledge the very significant contribution that Kevin has made over the years.

16. Three Waters Bimonthly Report September - October 2021

 

Committee Comment

1.         An update on the smart meters work programme(attached)  was provided by staff.

2.         Staff provided an update on the repair of the waste water treatment plant following the recent fire (attached).  Staff to prepare a memo on the location of odour complaints.

3.         Staff to circulate a memo and circulate it to Committee members on stormwater discharge and resource consenting.

8.     Three Waters Infrastructure and Environment Committee - Resource Recovery - November/December 2021

1.   Brief Summary

1.1       The purpose of this report is to update the committee on solid waste management and resource recovery services.

1.2       Key points in this report:

1.2.1   Closed Landfill remediation        

·    Council staff are working on remediation options for a number of at risk former landfill sites, including sites at risk from the effects of sea level rise.  

·    Key updates included in the report with good progress at Bexley and Le Bons Bay.

1.2.2   Organics Processing Plant transitional plan and options for the future

·    Staff continue to work closely with the Organics Processing Plant contractor on a transitional plan to meet the conditions of the abatement notice issued by Environment Canterbury. Work to clear the site of maturing compost stored outside is on schedule to be completed in mid-January, 2022.

·    Staff are working with a supplier to develop an options study for future sites. The investigation will seek to consider as broader range of options within the parameters of the Council resolution as possible to ensure no practicable alternative is overlooked. These options will then be assessed via multi-criteria analysis to identify preferred option/s.

1.2.3   Kerbside collection service and additional support

·    Staff will continue to work closely with the collections contractor Waste Management to address concerns across its delivery of a reliable and efficient service that meets our resident’s expectations
