Staff Recommendations

That the Hearings Panel:

1.         Receive the summary of submissions report

2.         Consider all submissions received during the public consultation process.

3.         Recommend that the Council adopt the final Te Wai Ora o Tāne Draft Integrated Water Strategy.

7.   Hearings Panel Consideration and Deliberation

 

The Hearings Panel considered the written and heard submissions received through the consultation and hearings process and proceeded to deliberate on the Te Wai Ora o Tāne Draft Integrated Water Strategy.

Staff Recommendations

That the Hearings Panel: 

1.       If it wishes to consider the privileged legal advice recommending changes to the Te Wai Ora o Tāne Draft Integrated Water Strategy, does so in public excluded.

 

2.       Recommends that the Council adopts the Te Wai Ora o Tāne Draft Integrated Water Strategy with the changes recommended in Attachment B to the Staff Report and in the publicly excluded legal advice, as the Council’s Te Wai Ora o Tāne Integrated Water Strategy to replace the following three Council water-related strategies:

a.      Water Supply Strategy 2009-2039, adopted by the Council in 2009

b.      Surface Water Strategy 2009-2019, adopted by the Council in 2009

c.       Wastewater Strategy 2013, adopted by the Council in 2013

3.       Delegates to the Chair of the Hearings Panel the authority to approve the Hearings Panel Report to the Council.

4.       Authorises staff in relation to the proposed Integrated Water Strategy to be recommended to the Council as an attachment to the Hearings Panel Report, to make any typographical changes, correct minor errors and omissions, and add photographic content and captions as appropriate to creating the public-facing version of the Te Wai Ora o Tāne Draft Integrated Water Strategy for adoption.

 

 

Committee Resolved BLHP/2019/00016

Resolution to Exclude the Public for Part of Deliberations

 

The Hearings Panel resolved at 1:26pm that the public be excluded from part of their deliberations to follow.  Reason for passing this resolution: good reason to withhold exists under section 7. Specific grounds under section 48(1) for the passing of this resolution: Section 48(1)(a)

 

Note: Section 48(4) of the Local Government Official Information and Meetings Act 1987 provides as follows: “(4)        Every resolution to exclude the public shall be put at a time when the meeting is open to the public, and the text of that resolution (or copies thereof): (a) Shall be available to any member of the public who is present; and (b) Shall form part of the minutes of the local authority.”

 

This resolution is made in reliance on Section 48(1)(a) of the Local Government Official Information and Meetings Act 1987.  The particular interest or interests protected by Section 6 or Section 7 of that Act which would be prejudiced by the holding of the whole or relevant part of the proceedings of the meeting in public are as follows:

The Hearings Panel reconvened at 11am on Thursday, 15 August 2019 in Committee Room 2

 

An apology was recorded from Councillor Galloway.

 

The Panel continued to deliberate on the Te Wai Ora o Tāne Draft Integrated Water Strategy, and the following notes were made from the discussions.

 

An adjournment was taken from 12.31pm to 1.18pm.

 

Notes:

 

1.       Check with staff whether the Council currently has a weed management plan in place for our waterways, prior to the Hearings Panel Report being presented to Council.

 

2.       The Panel notes a number of submitters have mentioned their concern in regard to the lack of rainwater reuse requirements, including education and incentives, and that this be further considered as part of the review of the Water Supply, Wastewater and Stormwater Bylaw 2014. 

 

3.       Request an informal review on the low level of response to the engagement that was undertaken around the Draft Te Wai Ora o Tāne Draft Integrated Water Strategy.

 

 

Hearings Panel Recommendation to the Council

 

Following its consideration of the written and heard submissions and deliberations on the Te Wai Ora o Tāne Draft Integrated Water Strategy, the Hearings Panel made the following recommendations:

 

 

Committee Resolved BLHP/2019/00017

That the Hearings Panel:

A.      Recommends that the Council:

1.         Adopts the Te Wai Ora o Tāne Draft Integrated Water Strategy with the changes indicated by the tracked changes in Minutes Attachment A, as the Council’s Integrated Water Strategy to replace the following three Council water-related strategies:

a.         Water Supply Strategy 2009-2039, adopted by the Council in 2009

b.        Surface Water Strategy 2009-2019, adopted by the Council in 2009

c.         Wastewater Strategy 2013, adopted by the Council in 2013

B.      Delegates to the Chair of the Hearings Panel the authority to approve:

1.         Any additional changes to the Draft Te Wai Ora o Tāne Draft Integrated Water Strategy in the form that it will be recommended to the Council that reflect the Panel’s deliberations that the Draft Te Wai Ora o Tāne Draft Integrated Water Strategy should:

a.        Incorporate best practice management on aquatic weed species (in section 7.3.4 of the Strategy).

b.        Include that different parts of the Council work together on integrated water management.

c.         Consider the use of ways to display information in regard to the progress of the Integrated Water Strategy and associated targets.

d.        Include in Section 7.8 (6) “As part of the Water Supply Implementation Plan consideration of incentives for rainwater reuse.”

e.         Make reference to, in the Purpose of the Strategy, the four well-beings under the Local Government Act 2002.

2.         The Hearings Panel Report to the Council.

C.      Authorises staff in relation to the proposed Te Wai Ora o Tāne Draft Integrated Water Strategy to be recommended to the Council as an attachment to the Hearings Panel Report, to make any typographical changes, correct minor errors and omissions, and add photographic content and captions as appropriate to creating the public-facing version of the Te Wai Ora o Tāne Draft Integrated Water Strategy for adoption.
