5.1       Graeme Barber, Pasadena Legal Road

             Graeme and Diane Barber addressed the Board regarding the Pasadena Reserve Memorandum that was included in the Board’s Area Report and expressed their concern regarding the current and expected height of the six oak trees planted in the road reserve. (Item 10 of these minutes refers.)

             Mr and Mrs Barber also raised concerns regarding whether under the District Plan the trees are planted within a Reserve or a Legal Road, whether the status and protection still applied if they were planted in the middle of a legal roadway and the requirement for neighbours to apply and pay for a resource consent for trees planted in a legal road.

             The Board requested that staff provide appropriate advice regarding who is responsible for the costs regarding resource consent applications and tree removal when the trees are planted on what is designated a legal road.

Community Board Resolved FWHB/2018/00093

Part B

The Fendalton-Waimairi-Harewood Community Board decided to:

1.              Request that staff provide an options report back to the Board regarding the Pasadena Reserve by the end of November 2018 that includes:

a)           an option for tree removal;

b)          an appropriate replacement planting plan;

c)           an option on the possible sale of land from the current road reserved.
