8.        District Licensing Committee - update of Committee requirements

1.   Purpose of Report

1.1       The purpose of this report is to update the Council on a drafting error in a previous report and to clarify the report writer’s intention with a view to rescind part of a previous Council decision.

 

2.   Staff Recommendations

That the Council:

1.         Receive the information in the report and note the drafting error in decision CNCL/2017/200323 from the Council meeting of 23 November 2017.

2.         Rescind clause 5.c of Council decision CNCL/2017/00323 and replace it with the following:

5.c          Appoint and remove from each District Licensing Committee as required the two committee members from the Council’s list maintained under section 192. Such appointments and removals to be made relying on the Council’s powers under section 189 and 194 of the Sale and Supply of Alcohol Act 2012, together with clause 31(1) of Schedule 7 of the Local Government Act 2002.

5.d         When the District Licensing Committee Chairpersons’ Panel appoints membership to committees to conduct public hearings on opposed applications, one of the appointed members should be a list only member.   

 

 

3.   Key Points

Previous Council decision

3.1       On 23 November 2017 the Council appointed the new membership and term of the District Licensing Committee (DLC) (CNCL/2017/00323).

3.2       The report was considered by the Council in public excluded as the report contained personal information on individual applicants obtained through a recruitment process. The section of the original report in question here does not relate specifically to any individual but rather the working of the District Licensing Committee in general. It is therefore considered appropriate that although the original decision was made in Public Excluded that this correction be made in a public meeting.

3.3       The clause in question from decision CNCL/2017/00323 reads as follows (emphasis added):

5.c.         Appoint and remove from each District Licensing Committee as required the two committee members from the Council’s list (one of which must be a List only member) maintained under section 192. (Such appointments and removals to be made relying on the Council’s powers under section 189 and 194 of the Sale and Supply of Alcohol Act 2012, together with clause 31(1) of Schedule 7 of the Local Government Act 2002).

 


 

Decision to be made.

3.4       The text of the report at paragraph 6.20 referenced the intention of the restriction which was that “when the DLC meets to conduct hearings on opposed applications that one of the three committee members be selected from the list only membership”. This intention was not reflected in the wording of the recommendation presented to the Council and the subsequent resolution adopted by the Council.

3.5       The intention was to guarantee that the list only members gain enough hearing experience for succession planning and to ensure adequate workload. However, there are a number of applications dealt with by the Committee that are “on the papers” and it would be impractical and costly to convene a hearings committee for these applications.

9.        Appointment of a hearings panel for the Summit Road proposed prohibited times on road restrictions consultation.

1.   Purpose of Report

1.1       The purpose of this report is, at the request of Deputy Mayor Turner and Councillor Scandrett, for the Council to appoint a hearings panel to receive public feedback on the Summit Road proposed prohibited times on road restrictions consultation and make a recommendation to the Council.

 

2.   Staff Recommendations

That the Council:

1.         Appoint a Hearings Panel to receive deputations, consider public submissions, and make a recommendation to the Council on the Summit Road proposed prohibited times on road restrictions consultation.

2.         Approve that the Hearings Panel comprise of Councillor David East (Chair), Deputy Mayor Turner, Councillor Scandrett and Community Board Members Melanie Coker, Ross McFarlane, Darrell Latham and Christine Wilson.

a.         That the Community Boards have the ability to substitute another member should the nominated representative not be available on the date set aside for hearings. Noting that Community Board representative needs to be consistent across all hearing and deliberation meetings.

 

3.   Key Points

3.1       Concerns have been raised regarding anti-social road use, safety, damage, vandalism, fire and rubbish along the Summit Road. The Council called for public feedback which took place from 10 July to 25 August 2017. The proposal consulted on seeks to restrict night time road access to Summit Road (between Rapaki Road and Gebbies Pass Road) and Worsleys Road (Summit Road to the start of the Track). The proposed time restrictions would prohibit vehicles under 3500kg on Summit Road (from Rapaki Road to Gebbies Pass Road) and Worsleys Road (from Summit Road to the start of the Track) from 10pm - 5am, Thursday to Monday, and public holidays.

3.2       During the consultation period, 865 submissions were received with 221 submitters in support of the proposal, 99 in support but with some concerns, and 545 not in support.

3.3       The original consultation document outlined the decision making process which included a staff recommendation being presented to a joint Community Boards and Infrastructure, Transport and Environment (ITE) Committee meeting for a recommendation to then go to the Council. This consultation crosses four Community Boards; Spreydon-Cashmere, Halswell-Hornby-Riccarton, Linwood-Central-Heathcote and Banks Peninsula.


 

3.4       It would not be practical to hold a joint meeting of four Community Boards and the ITE Committee, particularly if the purpose of the meeting is to receive deputations as the meeting would require a quorum from each Board and ITE. Consequently the four Boards were asked to nominate a representative from each Board to join the ITE Committee to hear any public deputations and make a recommendation to the Council. The nominees provided were:

·    Melanie Coker for Spreydon-Cashmere

·    Ross McFarlane for Halswell-Hornby-Riccarton

·    Darrell Latham for Linwood-Central-Heathcote

·    Christine Wilson and Deputy Mayor Turner for Banks Peninsula.

3.5       It is recommended that these Board nominees still be utilised if the hearings panel option is adopted.

3.6       Thursday 15 February 2018 has tentatively been set aside to hear from submitters and consider a recommendation to the Council.

3.7       As the consultation submission material did not require submitters to indicate if they wanted to speak to their submission it is unknown how many people will request speaking rights. Given the significant number of submissions received the numbers could be extensive. Large numbers are more easily managed under a hearings panel process.
