2.         Give general direction to staff on the tone, content, additions or deletions of the draft submission, or any other matter arising, for the purposes of further refinement of the submission prior to staff recommending the draft submission to Council.

2.         Give general direction to staff on the tone, content, additions or deletions of the draft submission, or any other matter arising, for the purposes of further refinement of the submission prior to staff recommending the draft submission to Council.

3.         Staff to create a second draft of the submission to send to a full Council workshop.

4.         Amendments and suggestions should include:

4.1   Emphasise the Council's concern re. Removal of submitters right to appeal. Stronger emphasis of Councils concerns in particular the erosion of participation rights and democratic process rights.

4.2   A more gentle approach around the Councils experience regarding paragraph 2.6.

4.3   Change the words "Hearings Panel Process" with "the truncated process" in paragraph 2.6

4.4   Emphasis to paragraph 3 on page 4.

6.        Submission fresh water management reform proposals

1.   Purpose of Report

1.1       This report seeks endorsement of the draft Council submission regarding the changes to the National Policy on Freshwater Management (NPS Freshwater Management) and other measures proposed by the Ministry for the Environment and the Ministry for Primary Industries (the Ministries).

 

2.   Staff Recommendations

That the Submissions Panel:

1.         Receive the information in this report and its attachments.

2.         Following any amendments to the draft, endorse the submission on the proposed National Policy Statement for Urban Development for lodgement (Attachment B).

 

 

3.   Key Points

3.1       On 20 February 2016 the Ministries released a discussion document (Attachment A) with a number of proposals to amend the current NPS Freshwater Management as well as other measures related to fresh water management.

3.2       Submissions on the proposals close 22 April 2016.

3.3       The key proposals include, but are not limited to:

·   amendments to the NPS Freshwater Management, such as:

·     applying the requirement to maintain or improve water quality so that it applies to each freshwater unit in the region rather than to the region as a whole;

·     setting requirements to exclude stock from waterbodies;

·     clarifying that national bottom lines and thresholds that apply to lakes are applicable to 'intermittently closing and opening lakes and lagoons';

·   introduction of national standards for technical efficiency and good management practice;

·   strengthening iwi rights and participation in fresh water management.

3.4       Environment Canterbury is preparing a submission jointly with some of the district councils in the region.  Due to the time frame in which this report had to be completed their submission was not available to inform this report or the Council submission.  However the general content and direction of their submission was discussed at a meeting with Environment Canterbury and representatives of Waimakariri and Selwyn District Councils and the Canterbury District Health Board on 22 March 2016.

3.5       The Council submission (Attachment B) addresses a number of matters raised in the discussion document.  The key points made in the Council submission are:

·   supports in principle the submission made by Environment Canterbury;

·   strongly recommends that the Government initiate a programme of work to expand the NPS-FM to include groundwater-related attributes;

·   supports the proposal to apply the requirement to ‘maintain or improve water quality’ to each freshwater management unit;

·   supports Proposal 1.2 as long as there are provisions to prevent long-term downward trending towards the next lower band;

·   supports the use of the Macroinvertebrate Community Index as a measure of ecosystem health;

·   recommends that local council representatives in the development of a macroinvertebrate measure and further suggest that these include Environment Canterbury and/or Christchurch City Council;

·   supports inclusion of “intermittently closing and opening lakes and lagoons” in the same thresholds and national bottom lines;

·   supports the addition of stock exclusion requirements, subject to some conditions; and

·   supports proposals for greater Iwi/Māori participation in freshwater management.
