1.   Purpose of Report

1.1       The purpose of this report is to present to the Hearings Panel the results of a consultation with the community under Section 138 of the Local Government Act 2002 in respect of the proposal to sell a portion of QEII Park, totalling 11.5 hectares, to the Ministry of Education.

 

2.   Staff Recommendations

2.1       That the Hearings Panel considers the results of the consultation process which are appended to this report and in doing so hears any submissions necessary.

2.2       That the Hearings Panel reports the outcome of that process and the submissions received to the Council for a decision. That report should incorporate a recommendation to the Council on whether it determines that the proposal to sell a portion of the land comprising 11.5 hectares at QEII is supported or not.

 

 

3.   Background

3.1       On the 25th February 2016 the Council considered a report from the Burwood Pegasus Community Board meeting of 15th February 2016 that recommended that the process to advance the proposed land sale of a portion of QEII Park, totalling 11.5 hectares, to the Ministry of Education be initiated by undertaking public consultation on the proposal. A copy of that report is appended as it provides the background of the proposal and reasons for the public consultation.

3.2       The Council resolved as follows:

4.   Consultation

4.1       The consultation has been undertaken and a report outlining the process and an analysis of the submissions is attached.

4.2       The consultation requirements and principles are set out in sections 78 and 82 of the Local Government Act 2002. The specific section that relates to the consultation that has been undertaken and forms the terms of reference for the Hearings Panel is Section 138.

 

5.   Process

5.1       Having consulted with the community the Hearings Panel shall hear and consider the submissions for the purpose of reporting to Council on whether the proposed disposal is supported or not in relation to the consultation. The outcome of that shall be reported to the Council from the Hearings Panel.

5.2       The Council agenda that contains the Hearings Panel findings report shall contain a parallel staff report that seeks the substantive decision to sell the land, or not, or alternative options depending on the Hearings Panel's recommendations. That report will deal with the sale terms and conditions and any matters if necessary arising from the Hearings Panel.
