Hearings Panel

The agenda was dealt with in the following order.

1.   Apologies

There were no apologies.

2.   Declarations of Interest

 

There were no declarations of interest recorded additional to those already noted in the agenda.

  

3.   Staff Report to the Hearings Panel on the Proposed Summit Road (Rapaki Road - Gebbies Pass Road) and Worsleys Road (Summit Road - start of the Track) Prohibited Times On Road Restrictions

 

 

The Hearings Panel received a staff presentation on the Proposed Summit Road (Rapaki Road- Gebbies Pass Road) and Worsleys Road (Summit Road- start of the Track) Prohibited Times On Road Restrictions, and on the results of the consultation undertaken on the Proposal.

The Hearings Panel refrained from considering the staff recommendation and deciding its recommendations to Council until after it had heard from submitters, considered their views, and entered its deliberations phase at Item 6 below.

Staff Recommendation

That the Hearings Panel:

1.         Recommends to Council that it does not approve the installation of a Prohibited Times on Road Restriction on Summit Road (Rapaki Road - Gebbies Pass Road) and Worsleys Road (Summit Road - start of the Track).

 

4.   Submissions Received on the Proposed Prohibited Times on Road Restriction on Summit Road (Rapaki Road - Gebbies Pass Road) and Worsleys Road (Summit Road - start of the Track)

 

 

The Hearings Panel received the submissions having read them ahead of the hearings.

Staff Recommendation

That the Hearings Panel:

 

4.1       Consider all submissions received, the staff report and other relevant considerations in its deliberations, before deciding its recommendation to the Council in respect of the proposal, which the Council may accept or reject; and

 

4.2       Note that the Local Government Act 2002 requires, as one of the principles of consultation, that “the views presented to the local authority should be received by the local authority with an open mind and should be given by the local authority, in making a decision, due consideration” (section 82(1)(e)).

 

 

 

5.   Hearing of Submissions

 

The Hearings Panel heard from the following submitters:

·         Summit Road Protection Authority

·         Mark Jarrett

·         Lawrence Hill

·         Summit Road Society (Inc.)

The meeting adjourned at 10:36am to 11:45am and reconvened at 11:47am.

The Hearings Panel also heard from Inspector Al Stewart of the New Zealand Police, who was able to assist the Panel in understanding the Police approach to anti-social road users on and around the Summit Road, statistical information relevant to driver behaviour in the area, and enforcement considerations relevant to the Proposal.

6.   Hearings Panel Consideration and Deliberation

 

The Hearings Panel considered the submissions received in accordance with the staff recommendation at Item 4 above and proceeded to deliberate on the Proposed Summit Road (Rapaki Road - Gebbies Pass Road) and Worsleys Road (Summit Road - start of the Track) Prohibited Times on Road Restrictions, noting the staff recommendation in the staff report copied at Item 3 above, which took account of the consultation results.

 

Hearings Panel Recommendation to the Council

Committee Resolved BLHP/2018/00029

The Hearings Panel recommends that the Council:

1.                   Does not approve the installation of a Prohibited Times on Road Restriction on Summit Road (Rapaki Road - Gebbies Pass Road) and Worsleys Road (Summit Road - start of the Track).

2.                   Requests that the Port Hills Management Plan be advanced as soon as possible recognising that the outcomes and objectives of that Plan may assist in achieving positive outcomes for the Summit Road and other affected roads in the area covered by that Plan.

3.                   Requests that a joint briefing on these matters be provided as soon as possible to the affected Community Boards.

4.                   Considers a lowering of the speed limit on the Summit Road.

5.                   Considers a mechanism that would potentially identify users of the Summit Road for crime prevention purposes.

6.                   Notes that the Police are agreeable to assisting with measures to curb anti-social behaviour on the Summit Road.

Hearings Panel Decision regarding approving its report to the Council

That the Hearings Panel delegate to the Chairman, Councillor David East, the authority to approve the Hearings Panel’s report to the Council on the outcome of the consultation and hearings process on the Proposed Summit Road (Rapaki Road - Gebbies Pass Road) and Worsleys Road (Summit Road - start of the Track) Prohibited Times on Road Restrictions.
